Understanding the Lemon Law in Colorado

The Colorado lemon law states that a consumer needs to report any problem with a vehicle that affects the vehicle’s use, value, or safety within one year of the original purchase date or during the term of the warranty, whichever happens first. Then, the vehicle’s authorized dealer, agent, or manufacturer will make the necessary repairs, regardless of whether or not the repair takes place after the vehicle’s expiration of the warranty or after the one year period.

According to the Colorado Attorney General, the lemon law, C.R.S. 42-10-101 through 42-10-107, applies only to “new self-propelled vehicles”. This includes pickups and vans, but not motor homes or motorcycles.

If the vehicle is unable to be fixed after a reasonable number of repair attempts, then a consumer should be able to return the vehicle for a full refund under the Colorado lemon law. A vehicle refund under the Colorado lemon law includes all applicable taxes, fees, and government charges. The consumer may also choose to have a replacement vehicle that is of comparable value and functionality. In order for a vehicle to be considered a lemon in Colorado, the problem must still exist after multiple repair attempts or must be out of service for repairs for a cumulative total of thirty days.

If a vehicle’s non-conformity is the result of after-market modifications that were not authorized by the manufacturer, dealer, or agent, or if a problem occurs because of the owner’s neglect or abuse of the vehicle, it is not a lemon vehicle under Colorado law.
