			<content:encoded><![CDATA[<p>After much discussion and controversy, the California Senate is considering new regulations on used car dealer lending practices. “Buy Here Pay Here” used car dealers would be considered “lenders” under the newly-introduced bill SB 956 and regulated by the Department of Corporations, according to <em>The Los Angeles Times</em>.</p>
<p>Pay Here Buy Here used car dealers operate differently than many other dealerships as they finance car purchases themselves, not through someone else such as a bank or credit union. As such, they make installment loans with consumers with very little government regulation. These types of dealers may charge too much for older model used cars, have unfavorable repossession policies and charge incredibly high interest rates for their loans.</p>
<p>The new bill would require, among other things, Buy Here Pay Here dealers to cap interest rates at 17%, prohibit placing GPS locaters on cars and devices to keep cars from starting when the consumer is behind in his or her payments.  </p>

			<content:encoded><![CDATA[<p>In an Orlando federal courtroom on Thursday, October 13th, a Florida man pleaded guilty to his involvement in an extensive car buying fraud business. According to the <em>Orlando Sentinel</em>, the operation was done with counterfeit or fake checks. </p>
<p>The wrongdoers solicited the fraudulent deals with numerous car dealerships in person, online and on the phone. The sellers were told payment would be sent via wire transfers and checks were sent from inoperative and fake accounts. Additionally, before the sellers could detect fraud, the defendant and his company attempted to shuffle cars to other dealers.</p>
<p>During the period of August 2010 to January 2011, forty illegal transactions were identified by government officials.  Investigators calculate the losses caused by the defendant’s criminal activity to be between $2.5 million and $7 million. </p>

			<content:encoded><![CDATA[<p>New York state officials want a car lender to repay its customers for what they say were unscrupulous business practices by enforcing certain demands on potential buyers with limited or poor credit histories, reports <em>Wallet Pop</em>, a division of AOL Finance.</p>
<p>According to the article, the New York Attorney General’s office is accusing a company located in Auburn, New York, and its owner, of misleading used-car loan applicants by forcing them to buy an extended warranty in order for them to qualify for a vehicle loan. The problem is that loan processors for the company allegedly stated falsely to customers that a loan could only be gotten if they also bought an extended warranty, which reportedly cost an extra $1,995 to $2,495. </p>
<p>Enforcing such requirements is illegal, according to the Attorney General’s office. In several instances, if a customer opposed the warranty, investigators allege the company enforced a previously undisclosed fee of $495. In a statement, the Attorney General stated that the company had repeatedly deceived customers into paying more for loans than was necessary. While no official numbers regarding how many consumers were wronged, it is believed hundreds were overcharged for a loan.</p>

<p>Working with Kansas City police, Missouri Department of Revenue agents performed compliance checks on various businesses. These checks made sure used car lots were following revenue laws regarding Vehicle Identification Numbers (VINs) as well as the titling and registering of vehicles. They also checked that the used car lots weren’t taking advantage of the general public.</p>
<p>Police and agents reported discovering businesses that employed illegal immigrants, had illegal drugs on their premises, and even found a chop shop during their sweep. A chop shop is a business that illegally disassembles stolen cars to then sell the vehicle’s parts. Nine used car lots were cited with failing to comply with state licensing requirements. Additionally, a fire marshal found 29 code violations.</p>

			<content:encoded><![CDATA[<p>Millions of dollars in fines have been filed against a man in Chicago for allegedly using about 180 salvaged vehicles as taxicabs. <a href="http://www.suntimes.com/news/watchdogs/2928828,CST-NWS-watchdogs1129.article"><em>The Chicago Sun-Times</em></a> reports that the cab company owner and his partners face $9 million in fines for using wrecked cop cars as cabs, making them the biggest offenders among a group of companies recently discovered to have collectively used 340 salvaged vehicles as taxicabs over the last four years. About twenty percent of the cabs have been determined to have <a href="http://www.california-lemon-law-blog.com/2010/09/salvage_titles_buying_a_used_car_in_california.html">salvaged titles</a>. Some of the salvaged cars were operated as cabs for months, and in some cases, years. </p>
<p>Salvaged vehicles are cars that insurance companies identify as total losses due to the degree of damage sustained in various types of accidents, due to wear and tear, or because of other incidents such as a flood or vandalism. A previously dismantled or junked vehicle can also be considered a salvaged car. </p>
<p>The article reports that most of the salvaged cars illegally operating as cabs were purchased outside of Illinois and given “clean” titles through a process called “title washing.” City officials discovered that five percent of Chicago’s 6,800 licensed cabs had once sustained significant enough damage to be declared wrecks, which makes their use as cabs illegal. </p>

			<content:encoded><![CDATA[<p>Consumers in Connecticut recently filed fraud complaints with the Department of Motor Vehicles in regards to an automobile dealership that closed. According to a report from <a href="http://www.thehour.com/story/485820"><em>The Hour</em></a>, the dealership closed still owing customers money and services. Some individuals even provided the car dealership with a cash deposit for an automobile that they have yet to receive. </p>
<p>In addition, customers have complained of paying for vehicle repairs that have not been completed as a result of the dealership unexpectedly closing. While these customers have been given their cars back, minus repair work, many of the dealership’s other customers learned of its closure by visiting the premises and seeing vehicles being towed away from the lot. </p>
<p>A new bill was introduced by Senator Bob Duff, vice chair of the General Assembly’s Transportation Committee, regarding existing lemon laws in Connecticut. <a href="http://www.senatedems.ct.gov/pr/duff-090721.html">Senate Bill 1081</a>, An Act Concerning the Functions of the Department of Motor Vehicles, went into effect in 2009, adding an extra disclosure provision for the sale of all used vehicles. The new law allows consumers to buy warranty protection for a used vehicle purchased on an “as is” foundation. </p>
<p>While some states provide equal consumer protection for new and used vehicles, <a href="http://www.howardsilverlaw.com/">used car fraud</a> still takes place. After purchasing a used car, whether a consumer suspects that the dealer charged them for features that he or she was told were free, rolled back the odometer, or failed to reveal that the vehicle was a “lemon buyback” or a rental car, consumers may be entitled to their money back, damages and attorney’s fees for this type of violation. </p>
